b) marketing activities in your manner in which you have consented to the legal basis for the processing of personal data is the legitimate interest of the company (Article 6 paragraph 1 point a) of the GDPR;

c) fulfill the legal obligations incumbent on the company based on generally applicable laws, including tax and accounting regulations - the legal basis for the processing of personal data is art. 6 par. 1 lit. c RODO,

d) conducting analytical and statistical activities - the legal basis for the processing of personal data is the legitimate interest of the company (Article 6 (1) letter f) of the GDPR, the legitimate interest of the company is to analyze the results of business operations,

e) in order to implement the legitimate interest of the company consisting in the possible determination or pursuit of claims or defense against claims - the legal basis for the processing of personal data is the legitimate interest of the company - art. 6 par. 1 lit. f RODO.

4. Your personal data may be shared:

a) forwarders, courier companies, carriers,

b) companies servicing electronic payments and payment cards,

c) lending companies,

d) IT companies dealing with IT systems, servicing our servers, computers and electronic mail,

e) companies dealing with our website,

f) entities providing services to our company in the field of accounting, service quality testing, debt recovery, legal, analytical and marketing services,

g) employees of LOXEE SP. Z O.O.

5. Your personal data will be processed for a period of time:

a) in the case of personal data processed for marketing purposes and providing services by electronic means - until you object to the processing of personal data in this respect.

b) in the case of personal data processed in order to perform sales contracts - for a period necessary to perform all obligations under the contract and after its completion for the purposes of:

pursuing claims in connection with the performance of the contract,

performance of obligations resulting from legal provisions, including in particular tax and accounting,

for statistical and archiving purposes,

maximum for a period of 10 years from the date of termination of the contract.

6. You have the right to access your personal data at any time and the right to rectify, delete, limit processing, the right to data transfer, the right to oppose, the right to withdraw consent at any time without affecting the lawfulness of processing (if the processing takes place on the basis of consent), which was made on the basis of consent before its withdrawal. 7. Providing personal data is voluntary, subject to two exceptions:

a) entering into agreements with the Administrator - failure to provide the personal data necessary to conclude and perform the Sales Agreement or the contract for the provision of Electronic Services with the Administrator in cases and in the scope indicated on the Online Store website and in the Online Store Regulations results in the inability to conclude this Agreement. Providing personal data is in this case a contractual requirement and if the data subject wants to conclude a given agreement with the Administrator, he is obliged to provide the required data.

2. Twoje dane osobowe otrzymaliśmy od Ciebie podczas zakładania konta w sklepie X WAKE SHOP

3. Twoje dane osobowe będą przetwarzane w celu :

a) umożliwienia świadczenia usług drogą elektroniczną oraz zawierania umów sprzedaży, obsługi reklamacji , wysyłek, płatności , zakładania i zarządzania Twoim kontem, rozwiązywania ewentualnych problemów technicznych – podstawą prawną przetwarzania danych osobowych jest art. 6 ust. 1 lit. b) RODO,

b) prowadzenia wobec Ciebie działań marketingowych w sposób na który wyraziłeś zgodę podstawą prawną przetwarzania danych osobowych jest prawnie uzasadniony interes firmy (art. 6 ust. 1 lit. a) RODO;

c) wypełnienia obowiązków prawnych ciążących na firmie na podstawie powszechnie obowiązujących przepisów prawa, w tym przepisów podatkowych oraz z zakresu rachunkowości - podstawą prawną przetwarzania danych osobowych jest art. 6 ust. 1 lit. c RODO,

d) prowadzenia działań analitycznych i statystycznych – podstawą prawną przetwarzania danych osobowych jest prawnie uzasadniony interes firmy (art. 6 ust. 1 lit. f) RODO, uzasadnionym interesem firmy jest prowadzenie analizy wyników prowadzonej działalności gospodarczej,

e) w celu realizacji prawnie uzasadnionego interesu firmy polegającego na ewentualnym ustaleniu lub dochodzeniu roszczeń lub obronie przed roszczeniami - podstawą prawną przetwarzania danych osobowych jest prawnie uzasadniony interes firmy - art. 6 ust. 1 lit. f RODO.

4. Twoje dane osobowe mogą być udostępnione :

a) spedytorom, firmom kurierskim, przewoźnikom,

b) firmom obsługującym płatności elektroniczne oraz kartami płatniczym,

c) firmom udzielającym kredytów,

d) firmom z branży IT zajmującym się obsługą systemów informatycznych, obsługą naszych serwerów, komputerów i poczty elektronicznej,

e) firmom zajmujących się nasza stroną internetową,

f) podmiotom świadczącym na rzecz naszej firmy usługi z zakresu księgowości , badania jakości obsługi, dochodzenia należności, usługi prawne, analityczne, marketingowe,

g) pracownikom firmy LOXEE SP. Z O.O.

5. Twoje dane osobowe będą przetwarzane przez okres::

a) w przypadku danych osobowych przetwarzanych w celach marketingowych oraz świadczenia usług drogą elektroniczną – do czasu wniesienia przez Ciebie sprzeciwu względem przetwarzania danych osobowych w tym zakresie.

b) w przypadku danych osobowych przetwarzanych w celu realizacji umów sprzedaży – przez okres konieczny do wykonania wszystkich obowiązków wynikających z umowy oraz po jej zakończeniu w celach :

dochodzenia roszczeń w związku z wykonaniem umowy,
wykonania obowiązków wynikających z przepisów prawa, w tym w szczególności podatkowych i rachunkowych,
w celach statystycznych i archiwizacyjnych,
maksymalnie przez okres 10 lat od dnia zakończenia umowy.

6. W każdej chwili masz prawo dostępu do treści swoich danych osobowych oraz prawo ich sprostowania, usunięcia, ograniczenia przetwarzania, prawo do przenoszenia danych , prawo wniesienia sprzeciwu, prawo do cofnięcia zgody w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania (jeżeli przetwarzanie odbywa się na podstawie zgody) , którego dokonano na podstawie zgody przed jej cofnięciem. W każdej chwili masz prawo do wniesienia skargi do Giodo gdy uznasz że przechowywanie twoich danych osobowych narusza przepisy ogólnego rozporządzenia o ochronie danych osobowych z 26-go kwietnia 2016.

7. Podanie danych osobowych jest dobrowolne, z zastrzeżeniem dwóch wyjątków:

a) zawieranie umów z Administratorem - niepodanie w przypadkach i w zakresie wskazanym na stronie Sklepu Internetowego oraz w Regulaminie Sklepu Internetowego danych osobowych niezbędnych do zawarcia i wykonania Umowy Sprzedaży lub umowy o świadczenie Usługi Elektronicznej z Administratorem skutkuje brakiem możliwości zawarcia tejże umowy. Podanie danych osobowych jest w takim wypadku wymogiem umownym i jeżeli osoba, które dane dotyczą chce zawrzeć daną umowę z Administratorem, to jest zobowiązana do podania wymaganych danych. Każdorazowo zakres danych wymaganych do zawarcia umowy wskazany jest uprzednio na stronie Sklepu Internetowego oraz w Regulaminie Sklepu Internetowego;

b) Obowiązki ustawowe Administratora - podanie danych osobowych jest wymogiem ustawowym wynikającym z powszechnie obowiązujących przepisów prawa nakładających na Administratora obowiązek przetwarzania danych osobowych (np. przetwarzanie danych w celu prowadzenia ksiąg podatkowych lub rachunkowych) i brak ich podania uniemożliwi Administratorowi wykonanie tychże obowiązków.

8. Twoje dane osobowe będą podlegały profilowaniu.

Będziemy korzystać z profilowania Twoich danych do celów marketingu bezpośredniego tzn np. automatycznie dobierzemy dla Ciebie reklamę w oparciu o wcześniejszą aktywność na stronie, zaproponujemy produkt zgodny z Twoimi zainteresowaniami , udzielimy odpowiedniego rabatu , przypomnimy o niedokończonych zakupach itp.
