Withdrawal from the contract

 

If you are a consumer - as a rule you have the right to withdraw from a distance contract.

You can withdraw from the contract by submitting a statement of withdrawal from the contract, e.g. by e-mail sent to: info@x-wake.com

Return the returned item immediately to the following address: 43-100 Tychy ul. Fabryczna 5, POLAND, however not later than within 14 days from the date on which you resigned from the contract.

You can withdraw from the contract within 14 days.

The 14-day deadline for withdrawal from the contract begins:

for the contract in which we issue the item, being obliged to transfer its ownership - from taking possession of the third party indicated by Ciebielub other than the carrier,

for digital content - from the date of conclusion of the contract.

To meet the deadline, it is enough to send a statement before its expiry.

The payments made by you, including the costs of delivering items on terms specified in the regulations, will be returned to you without delay, but no later than within 14 days from the date of receipt of the declaration of withdrawal from you.

We may withhold reimbursement of the payment received from you until you receive the item back or provide proof of sending it back, depending on which event occurs first.

Remember that the right to withdraw from a distance contract is not payable to the consumer, among others in relation to the contract:

in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specification or serving to satisfy his individual needs,

in which the subject of the service is an item subject to rapid deterioration or having a short shelf-life,

in which the subject of the service is an item delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery,

in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the packaging has been opened after delivery

for delivery of digital content that is not stored on a tangible medium, if the fulfillment of the service started with the consumer's express consent before the deadline for withdrawal and after informing him by the trader about the loss of the right to withdraw from the contract.

Complaints

 

If you are a Consumer, if the product purchased from us proves to be defective, you have the right to advertise it on the basis of warranty. The complaint is best submitted to the e-mail address: info@x-wake.com or by post to the following address: ul. Fabryczna 5, 43-100 TYCHY, POLAND

In connection with the disadvantage, you can request:

exchange of things for items free from defects,

removing the defect,

or make a statement about:

lowering the price,

withdrawal from the contract - in the case of a significant defect.

We respond to you for defects found before the expiration of two years from the date of delivery of the item.

As a rule, you can report a complaint within one year from noticing the defect, but the time for lodging a complaint can not be completed before the expiry of the seller's liability period.

Consideration of your complaint (response to it) will take place within 14 days from the date we receive your complaint application.

Odstąpienie od umowy

 

Jeśli jesteś konsumentem - co do zasady przysługuje Ci prawo do odstąpienia od zawartej na odległość umowy.

Od umowy możesz odstąpić, składając nam oświadczenie o odstąpieniu od umowy np. poprzez wiadomość e-mail przesłaną na adres: info@x-wake.com

Zwracaną rzecz zwróć do nas niezwłocznie na adres: 43-100 Tychy ul. Fabryczna 5 , POLSKA , jednak nie później niż w terminie 14 dni od dnia, w którym odstąpiłeś od umowy.

Od umowy możesz odstąpić w terminie 14 dni.

Bieg czternastodniowego terminu na odstąpienie od umowy rozpoczyna się:

• dla umowy, w której wydajemy rzecz, będąc zobowiązanymi do przeniesienia jej własności - od objęcia rzeczy w posiadanie przez Ciebielub wskazaną przez Ciebie osobę trzecią inną niż przewoźnik,
• dla treści cyfrowych - od dnia zawarcia umowy.

Do zachowania terminu wystarczy wysłanie oświadczenia przed jego upływem.

Dokonane przez Ciebie płatności, w tym koszty dostarczenia rzeczy na zasadach wskazanych w regulaminie zwrócimy Ci niezwłocznie, jednak nie później niż w terminie 14 dni od dnia otrzymania od Ciebie oświadczenia o odstąpieniu od umowy.

Możemy wstrzymać się ze zwrotem otrzymanej od Ciebie płatności do chwili otrzymania rzeczy z powrotem lub dostarczenia przez Ciebie dowodu jej odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.

Pamiętaj, że prawo odstąpienia od umowy zawartej na odległość nie przysługuje konsumentowi m.in. w odniesieniu do umowy: 

• w której przedmiotem świadczenia jest rzecz nieprefabrykowana, wyprodukowana według specyfikacji konsumenta lub służąca zaspokojeniu jego zindywidualizowanych potrzeb,
• w której przedmiotem świadczenia jest rzecz ulegająca szybkiemu zepsuciu lub mająca krótki termin przydatności do użycia,
• w której przedmiotem świadczenia jest rzecz dostarczana w zapieczętowanym opakowaniu, której po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu,
• w której przedmiotem świadczenia są nagrania dźwiękowe lub wizualne albo programy komputerowe dostarczane w zapieczętowanym opakowaniu, jeżeli opakowanie zostało otwarte po dostarczeniu
• o dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą konsumenta przed upływem terminu do odstąpienia od umowy i po poinformowaniu go przez przedsiębiorcę o utracie prawa odstąpienia od umowy.

Reklamacje

 

Jeśli jesteś Konsumentem, w przypadku gdy zakupiony u nas towar okaże się wadliwy, masz prawo reklamować go w oparciu o rękojmię. Reklamację najlepiej złożyć na adres e-mail: info@x-wake.com lub drogą pocztową na adres ul.Fabryczna 5 , 43-100 TYCHY , POLSKA

Reklamowany towar należy wysłać na adres: ul.Fabryczna 5 , 43-100 TYCHY , POLSKA  

W związku z wadą możesz żądać:

• wymiany rzeczy na wolną od wad,
• usunięcia wady,

lub złożyć oświadczenie o:

• obniżeniu ceny,
• odstąpieniu od umowy – w przypadku wady istotnej.

Odpowiadamy względem Ciebie za wady stwierdzone przed upływem dwóch lat od dnia wydania rzeczy.

Co do zasady reklamację możesz zgłosić w ciągu roku od zauważenia wady, ale czas na złożenie reklamacji nie może się zakończyć przed upływem okresu odpowiedzialności sprzedawcy.

Rozpatrzenie Twojej reklamacji (ustosunkowanie się do niej) nastąpi w ciągu 14 dni od daty otrzymania przez nas Twojego zgłoszenia reklamacyjnego.

Delivery time

The total delivery time with delivery is 1-2 business days if the product is available on stock. In another case, the delivery time is determined individually with the customer.

If the customer selects the method of payment by bank transfer or payment card, the time of order processing is counted from the date of crediting the Seller's bank account or settlement account.

Przesyłki towarów są realizowane przez firmę kurierską DPD.

• Kurier DPD (przedpłata) - 20 zł
• Kurier DPD (za pobraniem) - 30 zł
• Odbiór osobisty - 0 zł

Czas dostawy
Całkowity czas realizacji zamówienia wraz z dostawą wynosi 1-2 dni robocze jeżeli produkt jest dostępny na stanie magazynowym. W innym przypadku czas dostawy jest ustalany indywidualnie z klientem.

W przypadku wyboru przez klienta sposobu płatności przelewem lub kartą płatniczą, czas realizacji zamówienia liczony jest od dnia uznania rachunku bankowego lub konta rozliczeniowego Sprzedawcy.
